These Terms of Service (“Terms”) govern your use of archaiperformance.com, the Archai mobile app, the Archai Console, and Archai screenings, assessments and training programs (together, the “Services”), provided by Archai LLC (“Archai”). By using the Services, you agree to these Terms.
Our services
Archai provides movement screenings, athletic performance assessments, individualized training programs, form checks and related coaching. Program details, schedules and pricing are described on our website or in your agreement with us.
Not medical care
Archai does not diagnose, treat or cure any injury, disease or medical condition, and our Services are not a substitute for care from a physician, physical therapist or other licensed healthcare provider. Screening results describe movement and performance, not medical diagnoses. If you have pain, an injury or a medical condition, consult a licensed healthcare provider before starting or continuing any program.
Assumption of risk
Physical activity and exercise carry inherent risks, including injury. You agree to follow instructions, work within your abilities, stop and tell us if you feel pain or discomfort, and accept those risks to the extent permitted by law.
Minors
If an athlete is under 18, a parent or legal guardian must agree to these Terms on the athlete’s behalf and provide consent before individual assessments or programs. Team screenings are conducted with the approval of the team’s coaching staff or organization.
Accounts
You are responsible for keeping your account credentials secure and for activity under your account. Tell us promptly about any unauthorized use.
Payments and subscriptions
Paid Services are billed as described at purchase. Subscriptions renew automatically each billing period until canceled. You can cancel at any time with Manage billing in the Archai app (Profile) or in the Archai Console, or by emailing info@archaiperformance.com. Canceling stops future renewals. Payments are processed by Stripe through Archai’s own checkout, not through the App Store. The Archai app is currently offered in the United States. Cancellation, minimum-term and refund terms are those stated at the time of purchase or in your written agreement.
AI-assisted reviews
Some features use artificial intelligence to give Archai staff an advisory first review of movement videos. AI output is not a medical opinion, and Archai staff make the final assessment and training decisions.
Your content
You keep ownership of the videos and information you provide. You give Archai permission to use them to deliver and improve the Services for you. We will not use identifiable photos, videos or testimonials in marketing without your written permission (and a parent or guardian’s permission for minors).
Our content
Archai programs, exercise libraries, test protocols, reports, the app, the Console and website content are owned by Archai and are for your personal or team use only. Please do not copy, resell or redistribute them without permission.
Acceptable use
Do not misuse the Services, interfere with their operation, access accounts or data you are not authorized to access, or upload unlawful or inappropriate content.
Disclaimers and limitation of liability
The Services are provided “as is.” Individual results vary and are not guaranteed. To the extent permitted by law, Archai is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid Archai for the Services in the three months before the claim.
Changes and termination
We may update these Terms and will post the new version on this page. We may suspend or end access to the Services for violations of these Terms. You may stop using the Services at any time.
Governing law
These Terms are governed by the laws of the State of Florida.
